New Hampshire HR Compliance Guide for 2026: What "No Income Tax" Doesn't Cover

New Hampshire is lighter on employer mandates than its neighbors, but final pay deadlines and Massachusetts cross-border rules catch plenty of Southern NH employers.

New Hampshire has a reputation as the easy state for employers. No tax on wages, no state paid sick leave mandate and a minimum wage tied to the federal rate. That reputation is mostly earned, but it leads a lot of Manchester, Nashua and Seacoast employers to skip things that still matter.

This guide is general information, not legal advice. Confirm the details for your situation.

No Tax on Wages, But Watch the Border

New Hampshire does not tax wages, and the Interest and Dividends tax was repealed effective January 1, 2025. That does not mean your payroll has no state withholding.

  • An employee who lives in New Hampshire but works in Massachusetts is generally subject to Massachusetts withholding for that work, and often Massachusetts PFML and earned sick time too.
  • An employee who lives in Maine and works on the Seacoast may have Maine tax questions.
  • Remote employees in other states bring that state's rules with them.

If you have staff across a state line, see our multi-state payroll guide.

Final Pay Is Fast

  • A discharged employee must be paid in full within 72 hours.
  • An employee who quits must be paid by the next regular payday, or within 72 hours if they gave a full pay period's notice.
  • A laid-off employee must be paid by the next regular payday.

Willful violations can add liquidated damages that build daily. Plan final pay before the termination meeting, not after.

New Hampshire's Granite State Paid Family Leave plan is optional. Employers can buy coverage to offer about six weeks of 60% wage replacement, and individuals can enroll on their own. For employers competing with Massachusetts for talent, it can be a useful benefit, since Massachusetts workers already have PFML.

New Hampshire does not have a statewide paid sick leave mandate. Your own PTO policy still has to be written clearly and followed consistently, and New Hampshire treats promised vacation pay as wages.

Minimum Wage

New Hampshire follows the federal minimum of $7.25 an hour. In practice, competition with Massachusetts sets real wages far higher, especially in Southern NH.

Federal Rules Still Apply

FMLA at 50 employees, ADA at 15, I-9s for every hire and federal overtime rules all apply in New Hampshire. Most HR risk for NH employers comes from federal law and from employees who cross state lines.
