Law Enforcement Requests
Guidelines for law enforcement agencies and government officials requesting information about our clients.

King & Company Consulting is committed to the importance of trust and transparency in how we use and disclose our clients' data. Except as expressly permitted by a client contract, we will only disclose client data: (a) pursuant to a valid legal request, or (b) in the case of an emergency where there is a danger of death or serious physical injury to a person that we may have information necessary to prevent.
This page is solely intended for use by law enforcement or official representatives of government agencies ("Government Agencies"). It is not intended for information requests by our clients, their employees or end users, civil litigants, or criminal defendants.
Legal Request Requirements
Unless expressly permitted by a client contract, King & Co. will only disclose client data to Government Agencies in accordance with applicable law. Government Agencies are required to provide a valid subpoena, court order, or search warrant issued under the procedures described in the Federal Rules of Criminal Procedure or equivalent state warrant procedures upon a showing of probable cause.
In order for us to process a legal request, it must:
(a) Be sent by a law enforcement agency or official government entity via a registered email domain; (b) include valid and enforceable legal process (e.g., a subpoena, court order, or search warrant) that compels us to produce the information requested; (c) contain the name and contact information of the individual law enforcement agent or government representative authorized to serve the request; (d) state with particularity the categories of records or information sought; (e) include sufficient information regarding the client account (such as the name of the business entity) for us to identify the account(s) at issue; and (f) indicate the specific time period for which information is requested.
Emergency or Safety Concerns
King & Co. may disclose information to Government Agencies in the case of an emergency where there is a danger of death or serious physical injury to a person that we may have information necessary to prevent. We evaluate emergency disclosure requests on a case-by-case basis in compliance with relevant law.
In order for us to process an emergency disclosure request, it must: (a) be sent by a law enforcement agency or official government entity via a registered email domain; (b) contain the name and contact information of the individual making the request; (c) include the circumstances of the request and the nature of the claimed emergency; (d) explain why there is insufficient time to obtain and serve a valid legal demand; (e) state with particularity the categories of records or information sought; (f) explain how the information requested will assist in averting the claimed emergency; (g) include sufficient information to identify the relevant client account(s); and (h) indicate the specific time period for which information is requested.
Preservation Requests
King & Co. does not guarantee the existence or retention of particular client data beyond our standard retention periods. However, we will honor valid preservation requests from Government Agencies in accordance with 18 U.S.C. § 2703(f). Pursuant to a valid request, we will preserve specified, existing client data for up to 90 days and will extend the preservation for one additional 90-day period upon a valid request for extension.
Client Notice
Unless we are prohibited from doing so by law or court order, or there is a clear indication of illegal conduct or risk of harm, we will notify our client of a Government Agency's request before disclosing any of the client's data so that the client has an opportunity: (a) to address the request itself (in collaboration with us if necessary), and (b) to seek legal remedies.
If we are legally prohibited from notifying the client prior to disclosure, we will take reasonable steps to notify the client after the non-disclosure requirement expires.
Scope of Data We May Hold
Depending on the services we provide to a given client, the types of data we may hold include: business contact information, HR and employee records (for clients using our HR and payroll services), payroll and compensation data, benefits enrollment records, compliance documentation, staffing and scheduling data (for senior care facility clients), background check records, training records, and AI workspace content and usage logs. The specific data available varies by client engagement and service scope.
Reimbursement
King & Co. may seek reimbursement for costs associated with responding to law enforcement data requests, particularly if the costs incurred are the result of responding to burdensome or unique requests.
